Legal Statement

The following terms govern your access to and use of the website, premises, courses and services provided by First Aid and Healthcare Academy (UEN: 201500607E) (“the Academy”). By accessing this website, entering the Academy’s premises or enrolling in any course, you are deemed to have read, understood and agreed to be bound by these terms. The Academy reserves the right to amend these terms from time to time and such amendments shall take effect immediately upon publication on this website.
 
1. Standard of Conduct and Behavioural Expectations
1.1  The Academy maintains a strict policy of ensuring a safe, professional and respectful environment for all learners, staff, instructors and visitors. All persons who interact with the Academy, whether on its premises, during the conduct of any course, or through any mode of communication including but not limited to telephone, email, messaging platforms, social media and in-person interactions, are expected to observe standards of civility and mutual respect at all times.
1.2  The following conduct is strictly prohibited and shall constitute a material breach of these terms:
(a) the use of abusive, vulgar, offensive or threatening language directed at any member of the Academy’s staff, instructors, representatives or fellow learners;
(b) any act of intimidation, harassment, bullying or physical aggression;
(c) any discriminatory conduct or remarks on the basis of race, ethnicity, gender, religion, nationality, age, disability, sexual orientation or any other protected characteristic under the laws of the Republic of Singapore;
(d) any conduct that, in the reasonable opinion of the Academy, disrupts the orderly conduct of any course, creates a hostile environment or compromises the safety and wellbeing of any person on the Academy’s premises; and
(e) any refusal to comply with reasonable directions issued by the Academy’s staff or instructors in the discharge of their duties.
1.3  The Academy adopts a zero tolerance policy in respect of any conduct falling within Clause 1.2 above. Any person found to have engaged in such conduct may, at the sole and absolute discretion of the Academy, be immediately removed from the premises and have their participation in the course terminated without refund. The Academy further reserves the right to permanently bar such individuals from future enrolment and access to the Academy’s premises and services. Where the Academy deems it appropriate, incidents may be referred to the Singapore Police Force or such other relevant authorities.
 
2. Right to Refuse or Terminate Service
2.1  Without prejudice to any other rights or remedies available to the Academy, the Academy reserves the right, at its sole and absolute discretion, to refuse entry to its premises, decline any course registration, or terminate the participation of any individual in any course, where:
(a) the individual has breached or is reasonably suspected of having breached any provision of these terms;
(b) the individual’s conduct poses a risk to the safety, wellbeing or dignity of any person on the Academy’s premises;
(c) the individual has previously been the subject of a complaint or incident involving conduct falling within Clause 1.2 above; or
(d) such refusal or termination is otherwise necessary in the reasonable opinion of the Academy to protect its legitimate interests and those of its staff, instructors and learners.
2.2  In the event of termination of participation under this Clause, no refund, compensation or alternative arrangement shall be owing to the individual unless the Academy, at its sole discretion, determines otherwise.
 
3. Intellectual Property
3.1  All content published on this website and all course materials developed, compiled or used by the Academy, including but not limited to text, images, logos, trademarks, training guides, presentation slides, assessment materials, video content and multimedia resources, are the exclusive property of the Academy and are protected by applicable intellectual property laws of the Republic of Singapore and international treaties.
3.2  No part of this website or any course material may be reproduced, copied, distributed, modified, transmitted, displayed, published, sold, licensed, adapted or otherwise used in any form or by any means, whether electronic, mechanical, photocopying, recording or otherwise, without the prior written consent of the Academy.
3.3  Any unauthorised use of the Academy’s intellectual property may give rise to a claim for damages and may constitute a criminal offence under the Copyright Act 2021 and other applicable legislation.
 
4. Prohibition on Unauthorised Recording
4.1  No person shall photograph, film, video record or audio record any part of any course, training session, assessment, instructor, staff member or proprietary material of the Academy without the prior written consent of the Academy.
4.2  Any person found to be in breach of this Clause may be required to immediately delete all unauthorised recordings and may have their participation in the course terminated without refund. The Academy reserves the right to pursue legal action for any loss, damage or infringement arising from such unauthorised recording.
 
5. CCTV and Premises Monitoring
5.1  The Academy may operate closed-circuit television (CCTV) cameras and other surveillance or monitoring systems on its premises for the purposes of safety, security and the protection of its staff, instructors, learners and property.
5.2  By entering the Academy’s premises, you acknowledge and consent to such recording and monitoring. Recordings captured may be retained, reviewed and used as evidence in the event of any dispute, complaint, investigation or legal proceedings.
 
6. Limitation of Liability
6.1  To the fullest extent permitted by law, the Academy, its directors, officers, employees, instructors, agents and representatives shall not be liable for any direct, indirect, incidental, special, consequential or exemplary loss or damage of any kind arising from or in connection with the use of this website, attendance or non-attendance at any course, reliance on any information published herein, or any act or omission of the Academy.
6.2  While the Academy endeavours to ensure that all information on this website is accurate and current, the Academy does not warrant or represent that the content is free from error, complete, reliable or current. All information, including course schedules, fees, funding eligibility and certification requirements, is subject to change without prior notice.
6.3  Nothing in this Clause shall exclude or limit the Academy’s liability for death or personal injury caused by the Academy’s negligence, or for any other liability that cannot be excluded or limited under the laws of the Republic of Singapore.
 
7. Medical Disclaimer and Assumption of Risk
7.1  Courses offered by the Academy are intended solely for educational and training purposes and do not constitute medical advice, diagnosis or treatment.
7.2  Participants acknowledge that first aid and life support training involves physical activity including but not limited to kneeling, performing chest compressions, lifting and other hands-on techniques. Participants with pre-existing medical conditions, injuries, pregnancy or any health concerns are strongly advised to obtain medical clearance from a qualified medical practitioner prior to enrolment and participation.
7.3  Participation in any course is undertaken at the participant’s own risk. The Academy shall not be held liable for any injury, illness, aggravation of a pre-existing condition or any other adverse event sustained during or as a result of participation in any course.
 
8. Protection of Personal Data
8.1  The Academy collects, uses and discloses personal data in accordance with the Personal Data Protection Act 2012 (No. 26 of 2012) of Singapore (“PDPA”) and any subsidiary legislation, guidelines and codes of practice issued thereunder.
8.2  Personal data collected from learners and website visitors may be used for the purposes of course registration, administration, assessment, certification, communication, government funding applications and submissions to relevant accrediting and regulatory bodies.
8.3  The Academy shall not sell, rent or otherwise disclose personal data to third parties except where such disclosure is necessary for the purposes stated in Clause 8.2 above, or where disclosure is required or permitted by law.
8.4  By registering for a course or submitting personal data through this website, you consent to the collection, use and disclosure of your personal data for the purposes stated herein. You may at any time withdraw your consent, or request access to or correction of your personal data, by writing to the Academy at course@1st.sg. The Academy will endeavour to respond to such requests within a reasonable time in accordance with the PDPA.
 
9. Defamation and Malicious Communications
9.1  The Academy reserves the right to pursue all available legal remedies, including but not limited to claims for defamation, malicious falsehood and injunctive relief, against any person who publishes, communicates or causes to be published any statement that is false, misleading, defamatory or malicious concerning the Academy, its directors, staff, instructors, representatives, courses or services, on any platform including but not limited to social media, online review sites, internet forums, messaging applications and any other medium whether electronic or otherwise.
 
10. Governing Law and Jurisdiction
10.1  These terms shall be governed by and construed in accordance with the laws of the Republic of Singapore.
10.2  The parties irrevocably submit to the exclusive jurisdiction of the courts of the Republic of Singapore in respect of any dispute, claim or matter arising out of or in connection with these terms or the subject matter hereof.
 
11. Severability
11.1  If any provision of these terms is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable, such provision shall be severed from these terms and the remaining provisions shall continue in full force and effect.
 
12. Entire Agreement
12.1  These terms, together with the Academy’s course registration terms, refund policy and any other policies published on this website, constitute the entire agreement between the Academy and the individual in relation to the subject matter hereof and supersede all prior agreements, representations, undertakings and arrangements of any nature, whether written or oral.
